On Thursday, April 6, 2023, Council received confirmation that Lantzville Projects Limited (LPL) has executed a Licence of Occupation authorizing the District of Lantzville (the District) to construct, fence, maintain and use a trail for public pedestrian and bicycle access to Seaview Elementary School for a three year period (subject to earlier termination).
The Licence permits the District to construct and fence the three metres wide by approximately 60 metres in length trail within the Licence of Occupation area through LPL's private property at 7220 Ware Road from the District's Lancewood Avenue right of way to 7001 Lantzville School Road (Seaview Elementary School field), located as sho^\^l by the blue line on Schedule "A" below.
LPL will remove the cement barrier and the District will remove the brush to permit the construction of the trail and a six (6) foot high chain-link fence along the trail. Council has authorized staff to expend up to $8,000 to have the chain link fence constructed, to be funded from the Community Works (Gas Tax) fund.
The District will insure and indemnify the property owner (LPL) against claims, and will be responsible for any damage. The District looks forward to the community's responsible use and maintenance to support the continued use of the trail. Please pick up any waste, and comply with the prohibition of motorized vehicles.
Approximately two months ago,the property owner, LPL, fenced and placed 'No Trespassing Signage' on access points to their private properties in the community to prohibit unauthorized public access.
The District appreciates the civic-minded cooperation ofthe property owner, LPL,in offering the District a licence of occupation to permit the District to re-establish a trail to Seaview Elementary School field that Council was aware was sorely missed by the children, families and pedestrians who regularly used the trail.
Given the unique need for this trail, the District has taken these steps to re-establish the trail to Seaview Elementary School with the permission of the property owner, and has kept School District No.68 apprised. There are no plans to obtain permission to develop other trails or accesses across LPL lands. The District of Lantzville Council considers it is in the public interest to respect no trespassing signage installed on private property. Please be patient and avoid this area for the next couple of weeks while the trail and fence are 'under construction'. The opening of the trail for public use will be announced as soon as possible.
